Draft Rules Aim to Rein In Human-Like Artificial Intelligence and Emotional Interaction

Another move that China made in ensuring the future of artificial intelligence is the release of draft regulations to control AI systems that think, talk, and have emotional responses in a human like manner. The proposed framework, published by the Chinese regulator of cyberspace to get input, demonstrates the concern of the Beijing about the increasingly realistic AI tools and their effect on psychology, behaviour and reality of the users.

Artificial intelligence in China does not only exist in the back-end systems and industrial automation. The recent years have seen a fast growth of consumer-facing AI products, starting with conversational chatbots and virtual friends, which is followed by digital assistants that are able to sound more human, have specific personalities and emotional reactions. The tools are meant to be relatable, empathetic and even more comfortable. Although such human-like feature has led to adoption, it has also created concerns on emotional dependency, data security, and ethical responsibility. The draft rules are aimed at dealing with those risks before they entrench in ordinary life.

The core of the proposal is a good definition of that which will be subject to regulatory oversight. This may in practice imply a higher rate of auditing, internal control and better coordination of technical and compliance teams.

The proposal pays special attention to the psychological aspect of the use of AI. The providers would be supposed to recognize the user states and evaluate emotional reactions in the course of interaction. This is by keeping track of symptoms of intense emotions or excessive reliance on the AI service. In case these trends are identified, firms would be obliged to intervene through relevant actions. The draft does not specifically indicate how these interventions are to be executed, but it is clear that AI platforms are not to sit back and watch how bad usage patterns are adopted without taking any action.

This emphasis is indicative of the wider social arguments on the effect of technology on mental health. With AIs becoming more conversational and emotional, it will be possible to have experiences that are almost intimate. It can be a neutral or even positive relationship to some users. In some respects, to others, particularly to already vulnerable people it might help bolster isolation or misrepresent emotional boundaries. The approach of China implies the preference of preventative regulation over the response to extensive damage that has already taken place.

The control of content is among the key pillars of the suggested framework. The set of draft regulations is categorical that the AI services will not produce the content that threatens the national security, propagates rumours or contributes to violence or obscenity. These limitations are consistent with the current content regulation practices in China and echo long held preoccupations with social stability and information control. In the case of AI developers, this translates to strengthening content control processes, and making sure that generative models are well bounded by limitations.

Viewed in a larger framework, the draft regulations can be viewed as a continuation of the Chinese attempts to determine the future of AI development via policy instead of using market forces to do so by themselves. The nation has always been ahead of most countries in putting guardrails on emerging technologies, especially those that have social or ideological overtones. Regulators now seem to be eager to be ahead of a curve that other countries are still discussing by concentrating on emotionally interactive AI.

An unspoken message to tech industry too is also there. It encourages innovation, which should not be in the name of safety, ethics, or social responsibility. Firms that are creating human-like AIs will have to invest in both improved models and user experiences, as well as governance, compliance, and risk management. These requirements can be problematic to smaller developers and provide a benefit to larger firms that have developed compliance infrastructure.

The response of the people to such actions is bound to be ambivalent.
